Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Optimus Body Labs, LLC (“OptimusBody,” “we,” “us,” or “our”) governing your access to and use of optimusbody.com, the OptimusBody mobile application, our waitlist, and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using them, you represent that you are 18 or older and able to form a binding contract.

2. The Service

OptimusBody provides AI-assisted workout logging, photo-based nutrition estimation, goal planning, progress tracking, and an AI coach, for general health and wellness purposes only. We may add, change, or remove features at any time. Some features are in development, and joining the waitlist does not guarantee availability, pricing, or a release date.

3. Accounts

You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it current.

4. Health and Medical Disclaimer

OptimusBody is not a medical device and does not provide medical, dietetic, psychological, or professional health advice. Content and estimates are for general informational and educational purposes only. Always consult a qualified physician or licensed professional before beginning any exercise, nutrition, weight-loss, or supplementation program, especially if you are pregnant, nursing, have a medical condition, or take medication. Never disregard professional advice or delay seeking it because of something in the Services. If you think you may have a medical emergency, call your doctor or emergency services immediately.

5. AI-Generated Estimates

Nutrition values, calorie counts, macros, training recommendations, and coach responses are generated with the help of artificial intelligence and are estimates only — they may be inaccurate or incomplete. You are responsible for verifying information and for the data you enter, and you use any output at your own risk and discretion.

6. Your Content

You retain ownership of the content you submit, such as food photos, progress photos, and logs (“User Content”). You grant us a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely to operate and provide the Services to you, including processing through our AI providers. You represent that you have the rights to the content you submit and that it does not violate any law or third-party right.

7. Acceptable Use

You agree not to misuse the Services, including by: violating any law; infringing others’ rights; uploading unlawful, harmful, or infringing content; attempting to access accounts or systems without authorization; reverse-engineering, scraping, or overloading the Services; or interfering with their security or operation.

8. Intellectual Property

The Services, including software, design, text, graphics, logos, and the OptimusBody name and marks, are owned by Optimus Body Labs, LLC or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

9. Third-Party Services

The Services rely on third-party providers (for example, hosting, storage, email, analytics, and AI processing) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any estimate or result will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Optimus Body Labs, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (US$100).

12. Indemnification

You agree to indemnify and hold harmless Optimus Body Labs, LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms or any law or third-party right.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the federal laws of the United States and the laws of the state in which Optimus Body Labs, LLC is organized, without regard to conflict-of-laws principles. The exclusive venue for any dispute will be the state or federal courts located in that state, and you consent to their jurisdiction.

16. Miscellaneous

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
