This Privacy Policy explains how Optimus Body Labs, LLC (“OptimusBody,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you visit optimusbody.com (the “Site”), join our waitlist, or use the OptimusBody mobile application and related services (together, the “Services”). By using the Services, you agree to the practices described here.

1. Information We Collect

Information you provide directly. When you join the waitlist we collect your email address and any goal you select. When you create an account and use the app, we may collect your name, email, password, and profile details such as age, sex, height, weight, training experience, and goals. As you use the app, you may add content including food photos, progress photos, meals and nutrition logs, workouts, weight entries, and messages you send to the AI coach or to our support team.

Information collected automatically. When you use the Site or app, we and our service providers may automatically collect device and usage information such as your device type, operating system, app version, IP address, general location inferred from IP, pages or screens viewed, and interactions, using cookies and similar technologies. We do not collect precise GPS location unless you explicitly enable a feature that requires it.

2. How We Use Your Information

• Provide, operate, secure, and improve the Services and their features.
• Generate nutrition estimates, training insights, and AI coaching from the data you submit.
• Communicate with you, including waitlist confirmations, product updates, and support replies.
• Personalize your experience and remember your preferences.
• Monitor usage, prevent fraud and abuse, and maintain the safety and integrity of the Services.
• Comply with legal obligations and enforce our Terms of Service.

3. AI Processing

Food photos and coach messages you submit are processed by trusted third-party artificial intelligence providers solely to generate the estimates, insights, and replies you request. We do not use your personal content to train third-party foundation models, and we do not sell it. All AI-generated nutrition values and recommendations are estimates and are inherently approximate — they are not a substitute for professional advice (see our Terms of Service).

4. How We Share Information

We do not sell your personal information. We share information only as follows:

• Service providers. With vendors who perform services on our behalf — including cloud hosting, database storage, email delivery, analytics, and AI processing — under contracts that limit their use of your information to providing those services.
• Legal and safety. When required by law, subpoena, or legal process, or to protect the rights, property, or safety of OptimusBody, our users, or the public.
• Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
• With your consent. When you direct us to share your information.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we delete or de-identify your personal information within a commercially reasonable period, except where retention is required by law.

6. Data Security

We use administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit, access controls, and data isolation to your account. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

7. Your Rights and Choices

You may access, correct, export, or delete your information at any time from within the app, or by contacting us at hello@optimusbody.com. You can unsubscribe from marketing emails using the link in any such email; we may still send you essential service messages.

California residents have rights under the CCPA/CPRA, including the right to know, delete, correct, and limit the use of personal information, and the right not to be discriminated against for exercising them. We do not sell or share personal information as those terms are defined under California law.

EEA/UK residents have rights under the GDPR/UK GDPR, including access, rectification, erasure, restriction, portability, and objection. Our legal bases for processing are consent, performance of a contract, and our legitimate interests in operating and improving the Services.

8. Cookies and Analytics

We use cookies and similar technologies to keep the Site working, remember preferences, and understand aggregate usage so we can improve the Services. You can control cookies through your browser settings; disabling some cookies may affect how the Site functions.

9. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from them. The app is intended for users 18 and older. If you believe a child has provided us information, contact us at hello@optimusbody.com and we will delete it.

10. International Users

We are based in the United States, and your information may be processed in the United States or other countries that may have different data-protection laws than your own. Where required, we use appropriate safeguards for international transfers.

11. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policy.
